Tec Software takes privacy seriously. Therefore, in this Privacy Policy term (“Policy”) we explain the ways in which we use, store, share and protect the personal data collected from the use of our services and solutions and the visit to our websites. Also how data subjects can exercise the rights provided for in the applicable legislation. The personal data we collect depends on the context of your interactions with Tec Software. To make it easier for you to understand, we explain in this Policy how we treat the data of (i) customers (“Customers”), customers of Customers (“Consumers”) and users of our websites (“Users”), collectively (“Data Subjects” or “you”).
Specific Privacy Policies may apply for some of our products and services. For more information about our privacy practices related to a specific product or service, please visit the webpage for that product or service.

Tec Software® Data Source Informática Ltda, offers a portfolio of internet services, which include software as a service (SaaS), website hosting, cloud computing solutions, virtual store, among others. We are based at Av. Maria Teresa, 75 Grupo 318 e 319, Rio de Janeiro – RJ.

3.1 Data We Collect
In general, when a Customer (or for the purposes of this section, “you”) or your company contracts, uses, or interacts with the Services, we collect your personal data, which can be divided into three broad categories:
(I) Data you provide to us: When you hire, use, or interact with the services or otherwise communicate with us, you (or your company) may provide us with some data. This data includes:
- Business contact data, such as your name, job title, company, location, phone number, and email address;
- Marketing preferences;
- Account credentials, such as your email address, username, and password;
- Payment information, such as credit card details, bank details, and invoice address;
- Data related to technical support and troubleshooting. This data includes ticket opening data, such as the type of product or service related to your request for help, contact or authentication data, and the content of your communications with us, including phone recordings.

- To fulfill our contractual obligations to you or your company. This includes creating and managing the accounts you may have with us, verifying your identity, collecting amounts owed by you, providing, personalizing, and improving our services;

- Perform internal operations, including support, troubleshooting, data analysis, testing, research, and statistics;
- To reinforce our safety and security procedures, aiming to provide a safer and more effective service;
- Provide information about other services and/or products we offer, similar to those already contracted by you;

- Comply with legal or regulatory obligations, or as otherwise required in a judicial proceeding, by any law enforcement or government body that has jurisdiction, or claims to have jurisdiction.

4. Consumers
This section applies to the personal data of our Customers’ Consumers (or for the purposes of this section, “you”), where we act as a Controller. Please note that in most of the products and services we offer, Tec Software acts as Operators of personal data, according to the instructions of our Customers. Tec Software is not responsible for the privacy or security practices of our Customers. To understand how your data is handled by our Customers, it is important to consult their respective privacy policies.
4.1 Data we collect
(I) Data we receive from our Customers: Tec Software’s Customers may provide us with their personal data through the Services. When, for example, a Customer uploads their contact base to use our email marketing services, when you sign up for a Customer newsletter, when you provide your data for the purchase of a product, or issuance of NFE, NFCE or when you make a purchase in the Customer’s online store, the Customer may provide us with certain information such as your name, your email address, phone number, social security number, or payment details.
(II) Data we collect automatically: When you interact with the Services purchased by the Customer, such as when you interact with a marketing communication, browse the Customer’s website or make a purchase on the Customer’s online store, we may collect information about your device and your activities. This information includes:
- Data from devices you use to access the Services, such as your IP address, operating system, geolocation information, and unique device identifiers.
- Browsing data, i.e. data about how you use and interact with our Services, which may include the dates you used the Services and your browsing activities, such as the pages you viewed, whether you opened an email or added a product to your cart. We also collect information about the performance of the Services, including metrics related to the sending of emails or other forms of communication sent by our Customers through the Services.
(III) Data we collect from other sources:we may collect data from other sources, such as public databases, data from public profiles on social networks, credit protection entities, especially when you make a purchase on a website that uses our payment intermediation services.
4.2 How we use this data
We may use the data collected or received from our Customers’ use of the Services for the following purposes:
- Provide, personalize, and improve our Services;
- Perform internal operations, including support to our customers, troubleshooting, data analysis, testing, research, and statistics;
- Develop marketing strategies for our Clients so that they can deliver relevant advertising to you.
- Proceed with payment requests made by you, in payment intermediation operations.
- Manage risk and detect, prevent and/or remediate fraud or other potentially illegal or prohibited activities, as well as violations of applicable policies or terms of use;
- Establish, exercise and defend rights in judicial, administrative or arbitration proceedings;
- Comply with legal or regulatory obligations, or as otherwise required in a judicial proceeding, by any law enforcement or government body that has jurisdiction, or claims to have jurisdiction.

This section applies to the personal data we collect when Users (or for the purposes of this section, “you”) visit Tec Software’s websites.
5.1 Data We Collect
(I) Data you provide to us: our websites have a variety of ways through which you can contact us. You may provide us with personal data, for example, when you express an interest in obtaining more information about our products and services, participate in surveys, sign up for our newsletter, download informational content, or otherwise contact us. - Measure or understand the effectiveness of the advertising we serve in order to deliver relevant advertising to you;
- Manage risk and detect, prevent and/or remediate fraud or other potentially illegal or prohibited activities, as well as violations of applicable policies or terms of use;
- As necessary to establish, exercise and defend rights in judicial, administrative or arbitration proceedings;
- Comply with legal or regulatory obligations, or as otherwise required in a judicial proceeding, by any law enforcement or government body that has jurisdiction, or claims to have jurisdiction.

6. How we share personal data
We may share the personal data collected with third parties and business partners, which are relevant for the purposes of enabling the provision of the Services. Such sharing takes place based on the following criteria and for the purposes described below.
- Third-Party Service Providers: We work with third-party service providers to help us operate, perform, improve, understand, customize, support, and advertise our Services. When we share data with third-party service providers, we require them to use your data in accordance with our instructions and terms or with your express consent, where applicable.
- Credit Protection Entities: We may share your registration data with entities dedicated to reducing credit risk and protecting companies and individuals from fraud in order to validate the information provided by you.
- Regulatory, judicial or administrative authorities: We may share your personal information to provide the competent authorities with all the information that is requested in relation to the Holder and operations performed by him on the Sites. In addition, we may share your personal data with public authorities or private entities to combat fraud and abuse in the use of the Services, to investigate suspected violations of law, or to combat any other suspected violation of our policies and agreements.
- Transfer of Assets: In the event that the Tec Software company is reorganized or sold and all or substantially all of the assets are transferred to a new owner, your personal information may be transferred to the buyer regardless of your authorization to ensure continuity of services;
- With your authorization: In other cases not provided for above, if there is the purpose of sharing personal data and information, we will send you a notification with information regarding such sharing to request your consent, for a specific purpose.
7. Cookies and Tracking Technologies
We and our partners may use a variety of technologies to automatically collect and store data about your use of the Services. These technologies include cookies, pixels, web beacons, and SDKs. We use the information collected through these technologies to optimize and personalize your browsing experience, target advertising campaigns, develop and enforce security features and fraud prevention procedures, and other possible uses.
8. Transfers of personal data outside Brazil
We may transfer some of your personal data to service providers located overseas, including cloud service providers. When your personal data is transferred outside of Brazil, Tec Software will take appropriate measures to ensure adequate protection of your personal data in compliance with the requirements of applicable data protection legislation, including by entering into appropriate data transfer agreements with third parties of your personal data where required.
9. Interactions with Third-Party Websites
We may provide links to other sites on the Internet. TEC SOFTWARE IS NOT RESPONSIBLE FOR THESE SITES AND CONTENT, NOR DOES IT SHARE, ENDORSE, MONITOR, VALIDATE, OR ACCEPT THE WAY IN WHICH THESE SITES OR CONTENT STORAGE TOOLS COLLECT, PROCESS, AND TRANSFER YOUR PERSONAL AND PRIVATE INFORMATION. We encourage you to review the respective privacy policies of such websites to be adequately informed about the use of your personal information by other websites or other tools. We may record your access to third-party websites in order to measure the relevance of those websites to our users.
10. Security
The Personal Data processed by Tec Software is protected by physical, technical and organizational security measures to reduce risks of loss, misuse and unauthorized access, disclosure and alteration, such as firewalls and data encryption, physical access controls to data centers, as well as authorization controls for access to information.
11. Rights of the Holder
The Holders of personal data have some rights with regard to their personal data and can exercise them by contacting us through the e-mail: [email protected].
- Confirmation of the existence of personal data processing;
- Access to personal data, in accordance with applicable legislation;
- Correction of incomplete, inaccurate or outdated data;
- Data portability;
- Deletion of data, when it is processed based on the consent of the Holder or when the data is unnecessary, excessive or processed in non-compliance with the applicable legislation;

For security reasons, we will only be able to comply with your request if we are sure of your identity. Therefore, we may request additional data or information to confirm the identity and authenticity of the Data Subject.
Please note that, as mentioned above, in most of the products and services we offer, Tec Software acts as the operator of personal data, according to the instructions of our Customers. If you are a Consumer and wish to exercise your rights with respect to the personal data that Tec Software processes as a processor, you should contact the Customer who is using the Services.
12. Termination of Processing
This Privacy Policy applies to the above-mentioned circumstances for the entire period that Tec Software stores personal data. We store and maintain your information:
(I) for as long as required by law; (II) until the end of the processing of personal data, as mentioned below; or (III) for the time necessary to preserve Tec Software’s legitimate interest. Thus, we will process your data, for example, during the applicable statute of limitations or as long as necessary to comply with a legal or regulatory obligation.
The termination of the processing of personal data will occur in the following cases:
(I) when the purpose for which the personal data was collected is achieved, and/or the personal data collected is no longer necessary or relevant to the achievement of such purpose; (II) when the Data Subject requests the deletion of their data; and (III) when there is a legal determination to that effect. In cases of termination of personal data processing, except in the cases established by the applicable legislation or by this Privacy Policy, the personal data will be eliminated and this Policy will no longer be applicable to your relationship with Tec Software.

With the constant evolution of the business model, Tec Software reserves the right to change this privacy policy at any time, by publishing the updated version on its website. In the event of a material change in the processing of personal data, you will be informed and given the opportunity to review the revised policy before deciding to continue using our Services.
Cookie Policy
The purpose of this policy is to provide the audience of the website and services offered by Tec Software (“user” or “you”) with clear and accessible information about the cookies we use on our websites and mobile applications (collectively, “websites”) and how they reflect on the user experience.
This policy is in addition to our Privacy Policy.
1. What are cookies?
Cookies are essential tools in online browsing. 2. How cookies are used by Tec Software
Below we list the different types of cookies that may be used on Tec Software Sites.
2.1 Essential Cookies
Essential cookies are necessary for the operation of the Sites and the provision of services to you. Without these cookies, the Sites will not work as well as we would like, and we may not be able to provide certain services or features associated with them. Types of Cookies:

2.2 Preference Cookies

2.3 Analytics cookies

Anti-Spam Policy
Know Tec Software’s policies to combat spam practices. “Policy” should be understood for the purposes of this as being a series of measures to obtain an end. The purpose intended by Tec Software is to combat the practice of SPAM, as stated in the “ANTI-SPAM COMMITMENT” and the measures adopted are divided into:
- INFORMATIVE OR EDUCATIONAL: aimed at clarifying not only to Tec Software customers, but also to the general public WHAT IS SPAM and ways to minimize accusations of SPAM. These clarifications are contained in this policy statement and are supplemented by “tips available on the Tec Software website”;
- TECHNOLOGICAL: consisting of the technical tools made available to Tec Software customers not only to avoid receiving SPAM (such as filters, hidden nicknames, blocked e-mail lists, confirmation of origin, etc.) but also to avoid being accused of the practice of SPAM (active confirmation of registration), and;
- REPRESSIVE: consisting of contractual provisions that authorize Tec Software to summarily remove from the air the websites of clients that violate the ANTI-SPAM COMMITMENT assumed at the time of contracting the services.
1. AntiSpam Commitment of Tec Software and its customers
Tec Software, in sync with the best practices of the Internet and the most influential non-governmental bodies on the Internet, and following the appeal of its users, publicly manifests its AntiSpam commitment.
By it, Tec Software undertakes to hinder, by all means at its disposal, the practice of SPAM and to disclose the repudiation of this practice, as well as the purpose of preventing its customers from executing it.
On the other hand, anyone who becomes a customer of Tec Software accepts, fully and without restrictions, automatically, by the simple act of contracting any service provided by Tec Software, the commitment not to practice spam in any of its modalities or manifestations.
Therefore, all Tec Software customers are obliged to follow the rule of repudiation of SPAM, being responsible for complying with the rule of not practicing SPAM under any circumstances and under no pretext.
IF SPAM IS FOUND TO HAVE BEEN SENT BY ANY CUSTOMER, ITS “SITE” WILL BE TAKEN OFFLINE UNDER THE TERMS PROVIDED FOR IN THE RESPECTIVE CONTRACT, WITHOUT PREJUDICE TO OTHER APPLICABLE MEASURES.
Tec Software customers are prohibited from receiving more than 10% (ten percent) of bounced e-mails, unless another limit has been expressly established in the contract signed with the customer, in which case the limit established in the contract will prevail.
“Bounced email” is understood to be any type of error that compromises the delivery of the message to its recipient.
THIS IS THE ANTI-SPAM COMMITMENT OF TEC SOFTWARE AND ITS CUSTOMERS. COMPLY WITH IT AND MAKE SURE THAT IT IS FULFILLED FOR THE SAKE OF A BETTER INTERNET.
